TAKE NOTICE that a WARRANT OF EXECUTION has been issued out of the District Court, MARYBOROUGH upon Judgment obtained by the Enforcement Creditor in the above action and that ALL RIGHT TITLE AND INTEREST of the Enforcement Debtor’s half share of the following:
82 Caruanas Road, Oakenden
And the Debtor’s full interest in the following:
283 Eton-Homebush Road, Oakenden
Will be sold by PUBLIC AUCTION by the Bailiff, District Court, Mackay at the Jury Assembly Room, 1 st Floor at 12:00pm on the 23rd day of June 2014 unless the said Warrant and all costs have been fully satisfied prior to that date.

The cane farm comprises a 206.26 hectares and is located in the Oakenden district, approximately four kilometres south-west of the township of Eton, and 31 kilometres south-west of Mackay. The farm structural improvements includes four houses and three main machinery sheds. We note two of the houses have not been used in a number of years and are considered to be of minimal added value only.
The property has 154.47 hectares of measured cane land with production averaging 70.21 tonnes per hectare over the last five years with an average CCS of 14.88. Total average tonnage for the last five years is 8,885.51 tonnes per annum.
There is 569 megalitre water allocation attached to the land that is sourced from two underground irrigation bores and an outlet from the Kinchant Irrigation Scheme.
The sale also includes a half share of all machinery associated with the property.
The house on the 1,202 square metre allotment referred to as Lot 3, 283 Eton -Homebush Road is improved with an on-ground, four bedroom dwelling and is also located approximately four kilometres south-west of the township.
Conditions of Sale
10 per cent deposit (Cash or Bank Cheque) Remainder to be settled on the terms of Bailiff’s Auction -Contract of Sale for Freehold and or Leasehold Land. Property is sold “as is” and at the buyers risk. The seller does not know whether there are any other encumbrances, interests or rights against the property. Buyers must make their own enquiries on all matters affecting the property and make them prior to the sale. This sale is not conditional upon the outcome of any enquiry by the buyer.
The buyer will be required to enter a contract of Sale at the time of Purchase on the day of Auction.
