In the Magistrates Court of Queensland held at Petrie in the State of Queensland Plaint No..M 380/2007, between Moxon and Company Pty Ltd C/O Stubbs Barbeler, Level 4/33 Queen Street, Brisbane Qld (Plaintiff) and Warren Toby of 8 Carwell Avenue, Petire Qld (Defendant).

Take note that a Warrant of Execution has been issued on a Judgment obtained by the Plaintiff in the above action and that all estates, rights, titles and interests (if any) of the above mentioned Defendant in the under mentioned piece of land and appurtenances thereto, will be sold by Public Auction at the Magistrates Court, 7 Old Dayboro Road, Petrie Qld at 2:30 PM. on Thursday 4 th October 2007 unless the amount of the Warrant and costs are previously satisfied. All that piece of land being Lot 61 on Registered Plan 151623 County of Stanley Parish of Redcliffe being the whole of the land described in Title Reference 15568237 The land is subject to (1) Local Authority rates and charges accrued to the day of sale by auction. The property is situated at 8 Carwell Avenue, Petrie 4502 in the State of Queensland and is registered in the name of Warren Andrew Toby. The conditions of sale are that 10% of the purchase price to be paid on the day of the sale (cash or Bank Cheque acceptable) and the balance to be paid within (2) business days after the sale in exchange for a transfer of the property. Purchasers will be required to enter into a Contract of Sale at the time of purchase. Standard Conditions of Sale can be viewed at the Magistrates Court Registry at Petrie at any time prior to the auction date.
